This contract must be signed before any puppy leaves my care.  If you do not agree to this contract please do not contact us regarding the purchase of one of our puppies.
If you decide to purchase one of our puppies this will be signed at the time of pickup.

HEALTH GUARANTEE and CONTRACT 
Puppy Contract and Buyer / Seller Agreement


Health Guarantee

Seller certifies that this puppy is a purebred Dachshund, from a register-able litter with the American Kennel Club (AKC). This puppy is of good health and free of communicable diseases. Seller guarantees puppy’s health for 72 hours after sale. It is required that the puppy be checked by your licensed veterinarian, this visit is required for this health guarantee to be valid. You must provide receipt of visit within the 72-hr. period for the health portion to be valid. Buyer assumes full responsibility (100%) of all costs/care of the dog for the entire span of Buyer’s ownership: vet bills such as testing, housing, food, and medicine, etc.). If puppy is found to be unhealthy within the 72hour period, Seller must be notified immediately. A copy from the vet with full description of illness is required. Puppy will be replaced. No vet bills will be refunded at any time for any reason. Seller Guarantees the health of said puppy from all life threatening genetic/hereditary diseases until 12 Months Of age. If the pup is found to have a life threatening genetic/hereditary disease, I will replace the pup with a pup of equal value. DO NOT TAKE YOUR PUPPY TO REST STOPS, PUBLIC PARKS, PET STORES, PUPPY CLASSES, WALKS AROUND THE BLOCK, OR ANY PUBLIC PLACES WHICH COULD HAVE BEEN CONTAMINATED BY SICK DOGS THAT MAY CARRY COMMON CANINE VIRUSES, BACTERIAL DISEASES ETC., UNTIL ALL PUPPY VACCINATIONS ARE GIVEN, THESE COMMON CANINE VIRUSES AND DISEASES ARE VERY CONTAGIOUS AND OFTEN DEADLY. I do not cover any internal parasites (Coccidia, Giardia, Worms etc.) once the puppy leaves my home. Many are very common puppy illnesses that can occur at any time, usually brought on by stress, and are usually very easily treatable. I do however, pre-treat for both parasites (giardia & coccidia) to try and do prevention. All puppies are always wormed accordingly prior to leaving my home. Buyer agrees to be responsible and continue vaccinations and heart worm preventative. Hernias of any kind are not covered as they can occur at any time. I do not cover for alopecia (hair loss in dilutes- Isabella or Blue and in rare cases other colors) as this can occur at any time. If this does occur it is NOT life threatening and does not occur in all dilute pups/dogs. This puppy is not with the guarantee of being free from orthopedic deformities that are common to dachshunds including, but not limited to, backs and legs. As a breeder, I have done my best to breed healthy dogs.  If death occurs during the health guarantee period, breeder requires a Necropsy for verification of cause of death by a Licensed Veterinarian at Buyer’s expense. If the current owner REFUSES a necropsy, no replacement puppy will be granted REGARDLESS of diagnosis. Necropsy MUST be completed to confirm cause of death.
 

 

 

Refunds
No cash refunds will be given for any reason. If you choose to back out of a sale you are forfeiting all monies paid. Depending on the reasoning and how the transaction was handled, in the future I may consider the amount paid to be a value towards a future puppy. You must keep contact with me at all times! If something happens to the puppy of your choice in my care then the puppy will be replaced with a new puppy of equal value.

Spay/Neuter Agreement
ALL PUPPIES SOLD AS PETS - (female) spayed by the age of 8 months or (male) neutered by the age of 6 months. You agree to not breed that puppy under any circumstance (not intentionally, not unintentionally, and not accidentally.) Proof must be sent to us by the date provided on your contract. If you think your vet will not agree to this age timeline, please discuss this with them PRIOR to adopting from us so we can discuss this further.

 

Registration Papers

Buyer understands that said puppy is bred from AKC registered parents but is aware that their puppy DOES NOT come with papers unless otherwise discussed. PET PUPPIES are sold WITHOUT papers. FULL Registration papers are only available to pre-approved buyers. Buyer understands that this MUST be discussed PRIOR to placing a deposit or no papers will ever be provided. WE DO NOT under any circumstance sell our puppies with breeding rights to pet owners.

Medical Agreement

Buyer agrees that any major medical decisions will be discussed with the breeder prior to any decisions being made that will affect the life of the dog. Buyer agrees that they WILL NOT under any circumstance euthanize said dog without consulting the breeder first. If buyer decides to euthanize, breeder has the right to take over all medical care and take back possession of the dog if said breeder & their veterinarian feels euthanasia is not the right decision. By signing this contract buyer is allowing any and all vet records for said dog to be released to said breeder should there be any major medical issues to arise. This clause is in place because it is extremely important for us to track any and all medical issues in our lineage to ensure the health of our future dogs and puppies.

 

Injury/Neglect 
This agreement becomes null and void due to any injuries or neglect regardless of whether accidental or intentional. So please be careful and watchful of your new puppy. If anything does occur regardless if you have had the pup for a day or years, I would like to be notified.
 

Sizing
Breeder does not guarantee adult size on any puppy sold. Food, diet, exercise, age, and metabolism of each animal are different and have a direct impact on the adult “maintenance” weight. Seller states that said puppy is bred from 2 dogs that both qualify as Standard or Miniature Dachshunds (which ever you purchased from which stated parents standards) OR 1 mini parent, and 1 standard parent. Seller will try and give you an IDEA of the size of the puppy based from experience in past litters.

Diet

Said puppy is to remain on their current diet (food fed by the breeder) for a MINIMUM of one year for the health guarantee to be honored/valid. If for some reason the puppy needs to be switched to a different food for medical reason, I MUST be notified.

 

Color
Breeder does not guarantee the color or pattern of said puppy, I can only give you my best opinion and knowledge. Some puppies change with time, and age. I do promise to give you the most accurate description from previous experiences.
 

Contact Agreement
I have had contact issues with previous puppy buyers so this agreement is being added for the safety of my puppies. I am a breeder that likes to keep contact with all puppy buyers. I do have very strict agreements that come with purchasing one of my sweet babies. I ask that you keep some type of contact with me the entire life of said puppy/dog. I request photos every now and then to see that my pups are healthy and are being well taken care of and that you are abiding by my terms of agreement. If you do not respond to my phone calls or emails legal action may be taken. If you move I require that you contact me with your new address as AKC requires me to keep all puppy owner’s information UTD. If you do not agree to this then please let me know prior to purchasing a puppy if a deposit is placed on the puppy and you later decide you do not want to agree to my terms of sale (as stated on my site) you WILL NOT be refunded. 

 

Future Re Homing
Buyer agrees that if the time arises that Buyer can no longer provide a home for the puppy/dog, the Seller will be contacted. Seller is offered first chance of taking the dog back or you can let me find a new home that I approve of for the said dog/puppy. If you are out of state- The expense of returning the dog is your responsibility. I understand certain circumstances may come into play, so each situation will be addressed accordingly. This policy is in place to help ensure no puppy/dog goes to a shelter or into the hands of an irresponsible pet owner.

 

Penalty/Fines

If Buyer fails to provide the Seller with proof of a companion puppies spay/neuter procedure by the deadline described above in the spay/neuter agreement there will be a fine in the amount of $500.00 as a penalty for contract violation. In the event that the puppy is sold, given away, or taken to the pound/shelter at any time in its life and the Buyer is prosecuted there will be a fine in the amount of $500.00 as a penalty for contract violation. If the puppy/dog is still legally obtainable by the Buyer they agree to retrieve it and return it to the Seller.

 

Defamation/Slander

Seller is ALWAYS available to all of their clients to handle any issue that may arise. The buyer, and all associated with them, agree to never slander the Breeder in public forums, Facebook, twitter, websites, or any internet written media. Buyer agrees to contact the breeder privately with any concerns or issues which may arise to avoid lawsuit or slander.

 

**Please remember, puppies are LIVING creatures, not an inanimate object. There are imperfections in everything! However, we strive to provide everyone with pups that we think are “perfect” puppies to us! We will stand by all of our babies! Our references and Vet will atone to that. **

It is agreed that the place of venue for any legal dispute between the Buyer and Seller will be Mahoning County, Ohio. This contract represents the entire agreement between the parties. No other agreements or promises, verbal or implied are included unless specifically stated herein. When Seller and Buyer execute this contract, it will be binding upon both parties, subject and pursuant to the terms and conditions herein. Having read the above, and with full understanding of the contents herein, I willingly enter into this agreement. This contract is NOT transferable, and applies only to the ORIGINAL BUYER.
